TERMS AND CONDITIONS FOR THE SALE OF TRAINING SERVICES

General Provisions
These General Terms and Conditions of Sale (GTC) apply to Lassmann Education (Master Level) training courses sold by Dental Class Sp. z o.o. (Limited Liability Company) based in Łódź (90-213), at Rewolucji 1905 r. No. 52, Poland, registered in the National Court Register under number 0000649866.
The General Terms and Conditions of Sale also specify the terms and conditions under which Dental Class Sp. z o.o. provides services electronically, such as access to training materials. In this regard, the GTC serve as the regulations referred to in Article 8 of the Act of July 18, 2002, on the provision of services by electronic means.

The General Terms and Conditions of Sale are made available to the Customer free of charge before placing an order for the Course on the website www.lassmanneducation.eu.

By placing an order, the Customer confirms that they have read and accepted these GTC.

Definitions
For the purposes of these General Terms and Conditions, the following capitalized terms used in this document shall have the following meanings:

Course: Any stationary course (Lecture or Workshop) offered and organized or co-organized by Dental Class Sp. z o.o., which includes the registration of the order, provision of an online shopping platform along with educational resources related to the ordered course, and the issuance of a certificate. The courses, both practical and theoretical, are designed for dentists, dental hygienists, and other individuals involved in dental practice or the dental services market.

Lecture: A stationary course with the participation of a trainer, in the form of a presentation followed by a Q&A session.

Workshop: A stationary course with the participation of a trainer, during which participants practice new skills or work together with the trainer to solve a particular problem.

Platform: An online learning platform available at www.lassmanneducation.eu managed and operated by Dental Class Sp. z o.o., through which the company provides services outlined in points 1-6.

Training Materials: Educational resources made available to Course participants on the Platform. In order to access the Training Materials, the participant must create an account on the Platform.

Customer Account: An individual account created by the Customer on the Platform to place an order. The rules for creating a Customer Account are specified in the Platform’s terms and conditions available at www.lassmanneducation.eu.

Participant Account: An individual account created by a Course participant on the Platform to access Training Materials. The rules for creating a Participant Account are specified in the Platform’s terms and conditions available at www.lassmanneducation.eu.

Civil Code: The Act of April 23, 1964, the Civil Code (consolidated text Journal of Laws 2022, item 1360, as amended).

Order: An order for a Course placed by the Customer as described in § 3, section 2.

Customer: A legal entity, organizational unit without legal personality, or an individual conducting business activities.

Order Confirmation: The process of accepting the terms of the Order as described in § 3.

Participant: An individual designated by the Customer to attend the Course. Only individuals of legal age may participate in the Course.

GTC: These General Terms and Conditions of Sale.

Force Majeure: An unforeseen event caused by external factors that prevents proper fulfillment of the Order. Force Majeure includes, but is not limited to: natural disasters, fires, floods, strikes, power outages, epidemics, or threats of epidemics.

Seller: Dental Class Sp. z o.o. based in Łódź (90-213), at Rewolucji 1905 r. No. 52, Poland, registered in the National Court Register under number 0000649866.

Placing an Order
By placing an Order, the Customer confirms that they have read and accepted these GTC.
An order for a Course may be placed:
a) By phone – +48 535 777 756 (cost of call according to the operator’s rate) from Monday to Friday, between 8:00 AM and 4:00 PM;
b) Via the website www.lassmanneducation.eu
c) By email – [email protected]
An order may be placed by a person authorized to act on behalf of the Customer. A condition for placing an order for a Course is the creation of an individual account on the Platform by the Customer.
By placing the Order, the Customer confirms that they are aware of and accept the price, date, format, and location of the Course and accepts these Terms and Conditions and proceeds with payment for the Order.
The Seller verifies the received Order for its correctness, completeness, and payment.
After receiving the Order, the Seller confirms the registration of the Order by email to the address provided by the Customer in the Order, within 10 business days from the date of receiving the Order (Order Confirmation), and, in the case of a Course that includes training materials on the Platform, grants access to them or sends the Customer an access code for fulfilling the Order.
The Order becomes binding for both the Customer and the Seller once the Order is confirmed.
In the event that the Order cannot be fulfilled within the specified scope or date for reasons that could not have been foreseen earlier, the Seller reserves the right to refuse fulfillment of the Order or offer an alternative date for the service, notifying the Customer within 3 business days before the planned service date or immediately in case of unforeseen events.
A Participant in the Course must create a Participant Account on the Platform to access the Course content based on the granted access or code provided to the Customer by the Seller.

Courses – General Rules
The organizer ensures safety at the location of the course in accordance with relevant legal regulations.
The organizer ensures the course proceeds according to the previously published program.
For purposes related to procedures for applying for third-party funding for the Course, it is agreed that the contractual start date of the stationary Course is the first day of the stationary classes (lecture or practical workshop).
The organizer ensures high-quality course content delivered by instructors with appropriate qualifications and expertise.
Upon completing the Course, each participant will receive a certificate or confirmation upon the completion of specified activities within the Course, either on the Platform or through another method specified by the Seller. In the case of courses registered with the Medical Chamber, the organizer will issue a certificate of course completion or a confirmation of the course attended, with the appropriate number of educational points.
Changes to the Course date may occur due to Force Majeure events.

Cancellation and Changes to the Order
The Customer has the right to cancel the Order in full without giving any reason and without incurring any additional costs, up to 31 days before the confirmed start date of the Course.
In case of cancellation within less than 31 days before the Course date, the Customer will be charged the full cost of the Order, as specified in §7, section 4.
The Customer should inform the Seller of the cancellation by email to [email protected].
The Seller may introduce changes regarding the format of the Course due to Force Majeure circumstances that prevent the Course from being held on the specified date. The Seller reserves the right to conduct the Course on an alternative date.
The organizer reserves the right to cancel the course for reasons beyond its control. In this case, the organizer is not liable for costs incurred by the participant related to travel, accommodation, or other expenses.

Payment
Payment for the Order is made by the Customer:
a) By bank transfer to the Seller’s account,
b) Via the online payment service PayU/Blik.
For a Course priced below PLN 4500 gross, the Customer must pay 100% of the price upon placing the Order.
For a Course priced above PLN 4500 gross, the Customer can pay:
a) 100% of the price upon placing the Order, or
b) 30% of the price as a deposit when placing the Order (credited towards the total price), with the remaining 70% due no later than 31 days before the Course starts.
The total price of the Course, including the number of participants, is specified in the Order.
A VAT invoice is issued within 7 days from the date of payment. An advance invoice will be issued upon receipt of the payment, with the final invoice issued in the month the course takes place, after the service is completed. Advance invoices are accounting documents, but for settlement purposes, the final invoice is required. If no NIP number is provided by the participant, a personal invoice will be issued.

7. Complaints
The Customer has the right to file complaints in accordance with the relevant provisions of the Civil Code. The deadline for submitting a complaint is 7 days from the completion of the complained service. The Customer can submit a complaint by sending a request via the Contact Form on the website www.dentalclass.pl/kontakt. Complaints can be submitted:

The Seller will review the complaint within 10 working days from the date of its receipt.

The Customer will receive information regarding the resolution of the complaint within the aforementioned period in writing or in a durable medium sent to the email address, unless another form of communication is agreed upon with the Customer.

The Seller does not provide a warranty for the Course as defined by the provisions of the Civil Code.
8. Force Majeure
The Seller shall not be held liable for the failure to perform or improper performance of the Order due to force majeure.
9. Copyright
All content included in the Training Materials provided or made available to the Participant in connection with the Course, which constitutes a work under the Act of February 4, 1994, on Copyright and Related Rights, is subject to the economic copyrights of Dental Class sp. z o.o. or entities cooperating with Dental Class sp. z o.o. based on concluded agreements. In the case of works that Dental Class sp. z o.o. exploits under licensing agreements concluded with the owners of economic copyrights, these works are subject to the economic rights of these individuals. The provision of all materials to which third parties hold economic copyrights is made with respect for the intellectual property rights of those parties. The Participant is entitled to use the provided or made available materials solely for personal use. The Participant is not authorized to use these materials beyond the scope of personal use, especially not for commercial purposes, nor to disseminate the materials to which they have gained access.
10. Personal Data
This information applies to the Personal Data of persons representing, employees, Customers, and Course Participants provided to Dental Class sp. z o.o. The Data Controller (the Administrator or DPO) is Dental Class sp. z o.o., located in Łódź, ul. Rewolucji 1905 r. nr 52, 90-213 Łódź, Poland. Contact with the DPO can be made via email: [email protected], or by phone at the helpline: +48535777756, or in writing at the DPO’s address.
Personal Data will be processed by the Administrator in accordance with EU Regulation 2016/679 of April 27, 2016 (GDPR). Detailed principles of Personal Data processing by the Administrator are outlined below.
Purposes and Legal Bases for Processing Personal Data
Personal Data will be processed by the Administrator for the following purposes:
a) To fulfill the order. The legal basis for processing data is the necessity of processing for the performance of the contract.
b) For accounting and tax purposes. The legal basis for processing data is the fulfillment of a legal obligation imposed on the Administrator.
Additionally, the Administrator will process Personal Data based on the legitimate interest of the data controller, which in this case manifests in the following processing purposes:
a) The necessity of processing data of persons authorized by the Customer to perform the service on its behalf, as they represent the Customer for the purpose of service execution;
b) Contacting for matters related to the Order’s fulfillment, including organizing cooperation and supervising the execution of services;
c) Potentially pursuing claims and handling complaints related to the Course’s execution.
Data will be processed until the expiration of claims. In the case of Participants directed by the Customer to the Course, the course’s execution includes the registration of Participants, documentation of the Course’s conduct, and issuing certificates. The legal basis for processing data is the legitimate interest of the data controller in performing activities related to the Course contract, and when the Course is related to professional development requirements, the legal basis is the fulfillment of legal obligations.
Data Retention Period
Personal Data will be stored for at least the duration of the Order’s execution, in which persons whose data is being processed are involved. In situations where necessary for evidential purposes, Personal Data may also be stored until the expiration of claims related to business activities or until the conclusion of any legal proceedings concerning the Order. Data of individuals who placed the Order on behalf of the Customer, as well as data provided for billing purposes (e.g., email addresses for invoicing, data of the invoice issuer), and Participant data in the form of a list attached to accounting documents, will be stored until the expiration of the obligation to keep accounting and financial records, in accordance with applicable laws. Data from certificates issued will be stored for 6 years.
Categories of Processed Personal Data
For the purposes indicated above, the Administrator may process the following categories of Personal Data:

Identification data (first name, last name)

Employment data (position, place of work)

Contact data (phone number, email address, fax number),
and, in the case of representatives, any other data disclosed in the information corresponding to a copy from the National Court Register (KRS).
In the case of Participants, the Administrator receives from the Customer, as a rule, the following categories of Personal Data:

Identification data (first name, last name)

Employment data (position, place of work)

Contact data (phone number, email address).
Recipients of Personal Data
Personal Data will be accessed by the employees and collaborators of the data controller authorized to process data; data processors contracted by the Administrator and only on the basis of a data processing agreement, including IT services, advisory services, accounting services, and legal services.
Principles of Personal Data Collection
Personal Data is generally collected from the Customer. The Customer is responsible for informing individuals whose data is being processed about the planned provision of their data to the Administrator, including the scope and purpose of such provision. Personal Data may also be collected directly from the person concerned. Providing Personal Data is voluntary but necessary for the conclusion or performance of the Agreement. Failure to provide data may hinder or completely prevent the execution of the agreement.
Rights Regarding the Processing of Personal Data
The individual whose data is being processed may exercise the following rights with the Administrator:
a) The right to access their Personal Data and obtain information about its processing, and if the data is inaccurate, the right to request its correction.
b) The right to request the restriction of data processing in situations and under conditions specified in Article 18 of the GDPR (e.g., when data accuracy is being verified or when a person objects to data processing).
c) The right to data portability, i.e., the right to receive their Personal Data in a structured, commonly used format that is machine-readable, for the purpose of transferring data to another data controller.
d) The right to request the deletion of their Personal Data (“right to be forgotten”).
e) The right to object at any time to the processing of their Personal Data on grounds related to their particular situation.
Moreover, the individual whose data is processed has the right to lodge a complaint about the processing of their Personal Data by the Administrator with the President of the Personal Data Protection Office (address: ul. Stawki 2, 00-193 Warsaw).
11. Final Provisions
In matters not regulated by these Terms and Conditions, the provisions of the Civil Code shall apply. If any provision of these Terms and Conditions is deemed invalid or ineffective by any competent court or as a result of future legislative or administrative actions, such finding or actions shall not invalidate or render ineffective the remaining provisions of this document. If any provision of these Terms and Conditions is ultimately found to be illegal or ineffective, such provisions shall be excluded from these Terms and Conditions, and all remaining provisions shall continue to be fully valid and effective. In place of any such provision found to be illegal or ineffective, a provision of similar meaning shall replace it, reflecting the original intent of the provision, to the extent permitted by applicable law.

The failure of either party or any delay in exercising any right or remedy arising from the execution of the Order shall not constitute a waiver of such rights, and partial or one-time execution of any rights or remedies arising from these documents will not prevent the full execution of such rights or remedies at a later time.
All disputes arising from the execution of the Order placed by the Customer will be settled by the court competent for the registered office of Dental Class sp. z o.o. in Łódź.
Dental Class sp. z o.o. reserves the right to change the Terms and Conditions and the order form. For the Order, the applicable form and Terms and Conditions are those valid on the date the Order is placed.
